The Mercer SWCD reviews and investigates both allegations of potential pollution and actual pollution complaints.

What is a Potential Pollution Allegation?

Potential pollution allegations, such as improper winter manure application, are situations where pollutants could enter waters of the State, but no actual discharge is occurring. Procedures for handling nutrients entering waters of the State are outlined in Ohio’s Pollution Abatement Rules.

Different rules apply to the watersheds within Mercer County. For information on manure or fertilizer applications, please review the below documents.

How We Handle Complaints

Mercer SWCD takes all allegations seriously. When filing a complaint, please provide as much detail as possible to allow our staff to respond effectively. Key information includes:

• Location of the alleged action
• Type of manure and method of application/incorporation
• Description of cover in the field
• Approximate size of the application area

After investigating, staff will follow up with the complainant to inform them of the outcome. While the District does not have authority over nuisance issues such as odor or flies, we can direct you to the appropriate office.
